New York State Mandates Masks for Unvaccinated Health Workers

New York State has officially declared influenza as prevalent, prompting new health regulations for unvaccinated health care personnel. On November 22, 2023, State Health Commissioner Dr. James McDonald announced that those who have not received the flu vaccine must wear masks in patient and resident areas to mitigate the spread of the virus.

Health Regulations in Response to Rising Cases

The announcement comes as flu cases surge across the state, with a total of 17,783 positive cases reported in all 62 counties as of late November. Notably, lab-confirmed cases outside New York City have seen a staggering increase of 114% in just one week, rising from 1,688 to 3,619.

In New York City, cases have also escalated significantly, climbing by 119%, from 1,890 to 4,146. Alongside this surge, hospitalizations due to influenza have increased by 99%, from 208 the previous week to 413 statewide.

According to the new regulations, health care facilities and residential care agencies must ensure that unvaccinated staff wear surgical or procedure masks while influenza remains prevalent. Masks may be removed when staff accompany patients in community settings, provide speech therapy, or communicate with individuals who lip-read.

Encouraging Vaccination Among Residents

Dr. James McDonald emphasized the importance of vaccination in a press release, stating, “The flu vaccine is the best way to protect against infection and lessens symptoms if you get the flu. I encourage everyone six months and older to get a flu shot, and it’s not too late to protect yourself and your loved ones.”

Health officials had previously urged New Yorkers to receive the seasonal flu vaccine, especially after the reported deaths associated with influenza among children. During the 2024-2025 flu season, there have been 27 reported deaths in children younger than 18.

As flu season progresses, state health officials remain vigilant in their efforts to control the outbreak and protect vulnerable populations. The rising number of flu cases and hospitalizations underscores the critical need for compliance with health regulations and vaccination efforts.
