NYPD Retains 30 Officers Despite Failed Background Checks
The New York Police Department (NYPD) has reached a settlement allowing 30 rookie and probationary officers to retain their positions despite failing psychological evaluations or background checks. This decision comes after a legal challenge from the Police Benevolent Association (PBA), which represents the officers in question.
Initially, the NYPD had instructed these officers to either retire or face termination after it was discovered that they had been hired due to administrative errors. According to NYPD Commissioner Jessica Tisch, “I’m appreciative that we have found a path forward for these officers to protect and serve our city. As the NYPD closes the single highest hiring year on record, the department remains laser-focused on continuing to drive crime down and delivering on historic public safety gains.”
Settlement Details and Implications
The settlement, finalized on October 23, 2023, stipulates that the affected officers will undergo a probationary period of 36 months. This is an extension beyond the standard 24 months required for all new recruits. Should these officers engage in any misconduct during this time, the department retains the right to consider their previous failed evaluations and background checks when determining disciplinary action.
The officers involved were hired between 2023 and 2024 and had received final notices of disqualification during the application process for various reasons. These disqualifying factors included dishonesty regarding criminal convictions, past arrests, suspensions of driving licenses, and concealment of firearms. Despite these serious concerns, they managed to enter the police academy, raising questions about the hiring practices within the NYPD.
PBA President Patrick Hendry expressed gratitude for the resolution, stating, “We are grateful to have reached a resolution that allows these police officers to continue their careers.” This sentiment reflects a broader concern regarding the balance between maintaining public safety and ensuring fair treatment of officers.
