Boulder Activist Requests Dismissal of Charges Amid Controversy
UPDATE: Boulder activist Laura Gonzalez, 39, has filed a motion to dismiss all charges against her, raising urgent First Amendment concerns. Accused of harassing multiple individuals, including Boulder City Councilmember Matt Benjamin, Gonzalez faces serious allegations, including felony retaliation and misdemeanor harassment.
This pivotal legal battle is set against the backdrop of intense political expression regarding the city’s investments related to Gaza. The 1st Judicial District is prosecuting the case, prompting heated debates over the boundaries of free speech and activism.
Gonzalez’s attorney, Cameron Bedard of Rights & Liberties Law, argues that the prosecution aims to suppress fundamental political expression. The motion, filed on Wednesday, claims, “This prosecution targets core political expression,” stemming from Gonzalez’s vocal advocacy against Boulder’s refusal to adopt a ceasefire resolution and its investments in corporations linked to Israel’s military actions in Gaza.
“To ensure Ms. Gonzalez receives a fair trial and to maintain the integrity of the judicial process, we will address the merits of the case only through our formal court filings and courtroom proceedings,”
stated Brionna Boatright, spokesperson for the 1st Judicial District, emphasizing the importance of distinguishing between protected speech and alleged criminal conduct.
The charges arise from incidents at Boulder City Council meetings, where Gonzalez was a prominent figure advocating for humanitarian causes. In August 2025, she disrupted a council meeting, leading to a one-year suspension from attending in-person sessions. The situation escalated on September 3, 2025, when she confronted Benjamin and his wife at a local farmer’s market, allegedly bumping his wife and using derogatory language.
The motion to dismiss acknowledges the confrontation but disputes the characterization of physical contact. Gonzalez reportedly called Benjamin a “white supremacist settler” and a “baby-killer nazi.” Her defense maintains that such statements are political critiques rather than threats, asserting that they do not meet the legal definitions of harassment.
Additionally, another charge stems from an incident on August 21, 2025, where Gonzalez protested outside the Penfield Tate II Municipal Building, condemning the city’s policies towards Gaza. During this demonstration, she allegedly directed expletives at another activist, further complicating her legal situation.
Gonzalez’s defense cites landmark cases, arguing that her speech falls within protected political discourse. They assert that applying harassment laws in this context would deter activists from engaging with elected officials, undermining the First Amendment rights guaranteed by both U.S. and Colorado constitutions.
“The Constitution does not permit such a result, and this issue is capable of determination without trial,”
her defense argues, emphasizing the need for clarity on the limits of lawful activism.
As the legal proceedings unfold, a motions hearing is scheduled for April 9, followed by a jury trial commencing on June 8. The outcomes of these hearings could have significant implications for free speech rights in political discourse, especially amid contentious social issues.
This case reflects broader tensions regarding activism and governmental accountability, and it highlights the urgent need for clarity on the intersection of free expression and legal boundaries. As public interest grows, the implications of this case may resonate far beyond Boulder.
